Terms & Conditions

 

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  1. Entrepreneur: Gusted Art, located in Rotterdam, registered with the Dutch Chamber of Commerce under number [insert KvK number].

  2. Customer: any natural person or legal entity who enters into an agreement with the Entrepreneur.

  3. Agreement: the purchase agreement between the Entrepreneur and the Customer.

  4. Product: artworks and related items offered through the Gusted Art website.
     

Article 2 – Applicability

  1. These Terms and Conditions apply to every offer from Gusted Art and to every Agreement between Gusted Art and the Customer.

  2. Deviations from these Terms and Conditions are only valid if explicitly agreed upon in writing.
     

Article 3 – Offer

  1. The offer contains a complete and accurate description of the products offered.

  2. Obvious mistakes or errors in the offer are not binding on Gusted Art.
     

Article 4 – The Agreement

  1. The Agreement is concluded at the moment the Customer places an order and Gusted Art confirms it by email.

  2. Gusted Art reserves the right to refuse an order, for example in cases of suspected fraud or payment issues.
     

Article 5 – Prices and Payment

  1. All prices are stated in euros and include VAT, unless otherwise indicated.

  2. Payment must be made in advance through the available payment methods on the website.

  3. Orders will only be shipped after full payment has been received.
     

Article 6 – Delivery and Shipping

  1. Gusted Art will take the greatest possible care when receiving and executing orders.

  2. Delivery times are indicative and exceeding them does not entitle the Customer to compensation or cancellation, unless expressly agreed otherwise.

  3. The risk of loss or damage passes to the Customer at the moment of delivery.
     

Article 7 – Right of Withdrawal (for consumers)

  1. The Customer has the right to withdraw from the Agreement within 14 days after receiving the Product without giving any reason.

  2. During the withdrawal period, the Customer shall handle the Product and its packaging with care.

  3. If the Customer makes use of the right of withdrawal, the return shipping costs are at the Customer’s expense.
     

Article 8 – Complaints Procedure

  1. Complaints about the execution of the Agreement must be submitted as soon as possible, fully and clearly described, via info@gustedart.com.

  2. The Entrepreneur will respond to complaints within 14 days.
     

Article 9 – Liability

  1. Gusted Art is not liable for indirect damages, consequential damages, or loss of profit.

  2. The total liability of Gusted Art is limited to the amount paid by the Customer for the Product concerned.
     

Article 10 – Intellectual Property

All intellectual property rights relating to the Products, designs, images, and texts on the Gusted Art website remain with the Entrepreneur. It is not permitted to copy, trade, or use any materials without prior written permission.
 

Article 11 – Force Majeure

Gusted Art is not obliged to fulfill any obligation if prevented from doing so by force majeure (such as strikes, fire, transport disruptions, or third-party delivery issues).
 

Article 12 – Governing Law

  1. All Agreements between the Entrepreneur and the Customer are governed exclusively by Dutch law.

  2. Disputes will be submitted to the competent court in the district where the Entrepreneur is established.
